Jurisdiction:
Supreme Court enjoys original, appellate and advisory jurisdiction described as below:
Original jurisdiction
Original jurisdiction means the power to hear and determine a dispute in its original form at the first occurrence. The original jurisdiction deals with disputes between firstly, the Government and one or more states, secondly between the Government and any state or states on the one side and one or more than one state, or thirdly between two or more states inter see if the dispute involves any question on which the existence of a legal right depends.
Appellate jurisdiction
Appellate jurisdiction of the Supreme Court includes 3 types of cases: (i) Civil, (ii) Criminal and (iii) Constitutional. In Civil cases, an appeal lies before the Supreme Court from the judgment or final order of a High Court which involves a substantial question of law. In Criminal cases appeal lies before the Supreme Court from the decision of a High Court if (i) an appeal reversed the order of acquittal and has sentenced him to death, (ii) High Court has withdrawn any case before itself for trial from any court subordinate to its authority and in such trial has convicted the accused person and sentenced him to death, or (iii) certifies that the any such case is fit for an appeal before Supreme Court. In Constitutional matters, an appeal lies to the Supreme Court from the decision of a High court irrespective of being civil or criminal proceedings, if the High Court certifies that the case involves interpretation of the Constitution on a substantial point.
